What the bond actually guarantees

Tennessee’s Modular Building Act regulates the factory-built building units that are assembled on site, and licenses the manufacturers, dealers, and installers who handle them through the Department of Commerce & Insurance. Installers must post a $25,000 bond as a condition of licensure.

The bond is a code-compliance guarantee: it is for the benefit of any person who suffers loss or damage from code-related non-compliance with the Modular Building Act or its rules. It is a three-party arrangement among you (the principal), the surety, and the State of Tennessee (the obligee).

The bond term runs concurrent with the license year — July 1 through June 30 — so a new bond or continuation certificate goes with each renewal. If the surety pays a claim, you repay the surety; installers who build to code treat the bond as a license formality.
