About this bond

What the fuel tax bond actually covers

Oregon licenses dealers in motor vehicle fuel and sellers and users of use fuel through the ODOT Fuels Tax Group under ORS 319.010 to 319.880. The license is conditioned on a fuel tax bond that guarantees all applicable state taxes, fees, and penalties.

ODOT sets the amount at twice the estimated monthly tax for the dealer, seller, or user — so if your monthly tax runs about $3,000, the bond is roughly $6,000. The range runs from a $1,000 minimum up to $250,000, and can go higher if ODOT takes disciplinary action.

The bond stands behind the fuel tax you collect or owe — if you fail to remit, ODOT can recover against it. The surety can be released only after 60 days’ written notice to the department. Enter the amount ODOT set and we issue it on ODOT form 1322 at a flat 3% with no credit check.

ORS 319.030 / 319.052 (ODOT Fuels Tax Group, form 1322)Under ORS 319.030 and related sections (319.010–319.880), a dealer in motor vehicle fuel or a seller/user of use fuel must hold an ODOT license conditioned on a fuel tax bond, generally set at twice the estimated monthly tax (minimum $1,000, up to $250,000; higher on disciplinary action under ORS 319.052). The bond is filed on ODOT form 1322. Confirm the amount on your ODOT paperwork.
