Anytime Fitness LLC's franchise agreement requires its Ohio franchise owners to carry a $25,000 surety bond as a condition of the franchise, separate from any state licensing scheme — Ohio does not license health clubs, and this bond is not conditioned on an Ohio statute. Franchisees across most states carry the same $25,000 amount, because the franchisor, not a state regulator, sets it.
It's a three-party arrangement: you (the principal), the surety carrier, and the party the franchise agreement designates as obligee, with members who prepay for memberships as the protected parties. If a franchise closes or otherwise defaults on its obligations to members in a way the bond covers, a claim can be made against it.
It is not insurance for you — if the surety pays a claim, you repay the surety.
