What the ERISA fidelity bond covers

This is a fidelity bond, not a liability policy. It protects the employee benefit plan itself, the named insured, against loss from fraud or dishonesty by the people who handle its money: larceny, embezzlement, forgery, misappropriation and the like (29 CFR §2580.412-9).

How much does a North Dakota ERISA fidelity bond cost?The carrier prices it by the policy limit you select, and every price was read from its application: $300 for a 3-year term at any limit from $10,000 to $150,000, then a step at each limit — $326 at $250,000, $400 at $400,000 — up to $450 at the $500,000 limit. The credit tier plays no part.
What policy limit should I choose?The first limit at or above 10% of the funds each covered person handled in the prior plan year. A plan that handled $1,200,000 needs at least $120,000. This form writes limits from $10,000 to $500,000; a pooled employer plan or a plan that holds employer securities may need more, and should contact us before applying.
How long does the bond last?The policy runs a 3-year term from its effective date; the carrier sets the term, and ERISA allows one longer than a year (29 CFR §2580.412-19(a)). We track the term and send renewal notices 60 and 30 days out.
Is the requirement different in North Dakota?The bonding requirement is not. Who must be bonded and for how much is set by federal law and is the same in every state (29 U.S.C. §1112), and ERISA supersedes state laws that relate to a covered plan (§1144(a)). State insurance regulation still applies to the bond as an insurance product (§1144(b)(2)(A)), and a bond may not contain a clause that contravenes the law of the state where it is executed (29 CFR §2580.412-19(c)). So a plan sponsored in North Dakota is written on the carrier’s North Dakota form.
Is this the same as fiduciary liability insurance?No. The bond insures the plan against theft or fraud by the people who handle its funds; fiduciary liability insurance covers claims that a fiduciary breached its duties. ERISA requires the bond, not the insurance (DOL FAB 2008-04, Q2).
