What the driving school bond actually covers

North Dakota regulates commercial driver-training schools under N.D.C.C. ch. 39-25, administered through NDDOT. A school owner or operator must secure and submit a continuous surety bond with the license application for the protection of the contractual rights of students.

The implementing rule, N.D.A.C. 37-13-02-08, sets the bond at $5,000 for motor vehicle driver's-license instruction, issued by a company authorized to do business in North Dakota. The surety may cancel the bond on thirty days' written notice to the director.

If a school takes a student's tuition and fails to deliver the instruction, the student can recover against the bond — and if the surety pays, the school repays the surety.
