What the expense bond actually guarantees

North Carolina cannot examine an out-of-state collection agency the way it examines a local one, so G.S. 58-70-20 makes every nonresident applicant file an additional bond with the Commissioner of Insurance for the purpose of reimbursing the Department for expenses incurred in visiting and examining a nonresident collection agency — specifically in connection with a federal bankruptcy or State receivership proceeding in which the agency is the subject.

The statutory amount is $10,000, and under G.S. 58-70-5(a)(5) an alien corporation posts double the amounts set by G.S. 58-70-20 — so an agency headquartered outside the United States files this bond at $20,000. It is a separate obligation from the initial-permit bond that protects your creditor clients; alien agencies carry both.

This bond runs to the Department rather than to your clients, and it stays in place until terminated by the Commissioner. It is not insurance for you — if the surety pays, you repay the surety. Permits run July 1 to June 30 under G.S. 58-70-35(b), so the bond is keyed to those statutory dates; we send renewal notices 60 and 30 days out.
