What the bond actually guarantees

North Carolina permits collection agencies through the Department of Insurance under Article 70 of Chapter 58. G.S. 58-70-20 requires a bond of $10,000 for an initial permit, and the bond must expressly provide that it is for the benefit of any person, firm or corporation for whom the collection agency collects accounts. Under G.S. 58-70-5(a)(5), an alien corporation — one headquartered outside the United States — posts double the amounts set by G.S. 58-70-20, so the initial bond is $20,000.

It is a three-party arrangement: you (the principal), the surety carrier, and the State of North Carolina through the Commissioner of Insurance (the obligee). The bond stands behind the money you collect — it stays in effect until all moneys collected have been accounted for, so it cannot simply be cancelled when a permit lapses.

Permits run on a statutory year: G.S. 58-70-35(b) makes each permit run from July 1 through June 30 of the following year, which is why this bond renews on June 30 dates. It is not insurance for you — if the surety pays a claim, you repay the surety. We track the term and send renewal notices 60 and 30 days out.

N.C.G.S. §§ 58-70-20, 58-70-5(a)(5)Section 58-70-20 of the North Carolina Collection Agency Act sets the bond a collection agency files with the Commissioner of Insurance: ten thousand dollars ($10,000) for the initial permit, with the bond expressly for the benefit of any person, firm or corporation for whom the agency collects accounts, remaining in effect until all moneys collected have been accounted for. Section 58-70-5(a)(5) provides that in the case of an alien corporation the surety bond requirements are double the amount set by G.S. 58-70-20 — $20,000 for the initial permit. Under G.S. 58-70-35(b), each permit runs for one year beginning July 1 and ending June 30 of the following year.
