About this bond

What it is and who needs it.

What the bond actually guarantees

A right-of-way bond is a sidewalk and roadway restoration guarantee. When you work in the New York City right of way — opening pavement, installing or repairing sidewalk, or other roadway work — the city wants a financial backstop that the area will be restored to city standard.

It's a three-party arrangement: you (the principal), the surety carrier, and the City of New York (the obligee), with NYC DOT administering the permit. If the right of way is left unrestored, settles, or the permit conditions are violated, the city can recover against the $25,000 bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. Contractors who restore the right of way properly treat the bond as a permit formality, not a risk.

NYC Department of Transportation (Highway Rules)The City of New York, through the Department of Transportation, requires a surety bond for sidewalk and roadway right-of-way permits under the NYC DOT Highway Rules (Title 34 of the Rules of the City of New York). The $25,000 amount and bond form are set by NYC DOT — confirm your required amount with DOT when you file.

Do I pay the $25,000? +
