Nebraska regulates money transmission under the Nebraska Money Transmitters Act, Neb. Rev. Stat. §§ 8-2701 to 8-2748, administered by the Department of Banking and Finance. An applicant for a money transmission license must provide, and a licensee must at all times maintain, security consisting of a surety bond in a form satisfactory to the Director.
Section 8-2731(2) sizes the bond at the greater of $100,000 or an amount equal to 100% of the licensee’s average daily money transmission liability in Nebraska, calculated for the most recently completed three-month period, up to a maximum of $500,000. A licensee that simply carries the $500,000 maximum is not required to run that calculation at all.
The bond protects the people whose money moves through you: any claimant against the licensee may file a claim or bring suit directly on the bond, and the Director may bring suit on a claimant’s behalf. Cancellation requires thirty days’ written notice to the Director and does not wipe out liability that accrued while the bond was in force. If the surety pays, you repay the surety.
