About this bond

What it is and who needs it.

What the distributor bond covers

Missouri taxes motor fuel under Chapter 142. A licensed distributor — a business that first receives motor fuel into the state for resale or use — posts a bond with the Department of Revenue, conditioned on paying the motor fuel tax the distributor owes, under RSMo 142.896.

The Director sets the bond at not less than three months' total liability based on the gallons the distributor is estimated to handle, with a maximum of $150,000 for gasoline and diesel fuel each. Statute also lets a qualifying distributor participate in a Motor Fuel Bond Trust Fund arrangement instead of a traditional bond.

It is not insurance for you — the bond backs the distributor's obligation to remit the tax. If the state pays a claim, you repay the surety. We issue the amount the Director set, from a $100 minimum, at 1.2% of the bond amount.

RSMo 142.896Missouri Revised Statute 142.896 requires a distributor licensed under Chapter 142 to post a bond, conditioned on the payment of motor fuel tax, in an amount not less than three months' total liability based on gallons handled as estimated by the director, with a maximum of $150,000 for gasoline and diesel fuel separately. The statute also establishes a Motor Fuel Bond Trust Fund as an alternative for qualifying distributors.
