What the soil erosion bond actually covers

Oakland County administers Part 91 of the Natural Resources and Environmental Protection Act (1994 PA 451, as amended) as a county enforcing agency — counties are mandated by statute to administer and enforce Part 91 where a city, village, or township has not adopted its own approved ordinance. A Soil Erosion and Sediment Control (SESC) permit from the Water Resources Commissioner is required for an earth change disturbing more than one acre, or an earth change of any size within 500 feet of a lake, stream, wetland, or county drain.

The bond is a performance guarantee that you will install and maintain the erosion and sediment control measures shown in your approved plan — silt fence, stabilization, inlet protection — for the life of the project. If the measures fail or you abandon the site without stabilizing it, the county can draw on the bond to complete the corrective work.

It is a three-party arrangement: you (the principal), the surety, and Oakland County (the obligee), with adjacent property owners and waters of the state as the protected interest. It is not insurance for you — if the surety pays a claim, you repay the surety.
