Who posts one
The applicant — the party seeking the TRO or preliminary injunction. Federal practice makes this explicit under Rule 65(c), and most state rules mirror it.
What it covers
The restrained party's costs and damages if the injunction turns out to have been wrongly granted. It is the court's way of pricing the risk of acting before the merits are decided.
How the amount is set
By the judge, in the order granting relief — sized to the harm the restraint could cause. There is no fixed formula, which is why these are underwritten rather than instantly priced.
