INDOT’s single highway permit program covers work in the state right of way by category — occupancy, driveways, and a miscellaneous category for work that doesn’t fit the standard buckets. Whatever the category, work in the right of way is conditioned on a surety bond.

The bond guarantees you will complete the permitted work to INDOT’s standards and restore the right of way to its proper condition. If the work is left unfinished or damages the highway, INDOT can recover against the bond to make it right.

INDOT sets the penal sum to cover the scope of your specific project, so it varies. It is not insurance for you — if the surety pays, you repay the surety. We issue whatever amount the permit names, at a flat 3% with no credit check.
