What the title agent bond actually covers

Idaho licenses title insurance agents county by county through the Department of Insurance. Under Idaho Code § 41-2710, an agent must obtain a license for each county and, as a condition of that license, file and pay for a surety bond — the same bond required of an escrow officer.

The bond is a consumer-and-public-protection guarantee: it stands behind your faithful handling of title and escrow work and your compliance with Idaho's title insurance law. If an agent mishandles funds or violates the chapter and causes loss, the harmed party can recover against the bond.

The amount scales with your operation. The Department's published figure is a $10,000 minimum per county, increasing in $10,000 increments with each additional escrow officer in the county, up to a $50,000 maximum. Enter the figure that applies and we issue it at a flat 3% with no credit check.

Idaho Code § 41-2710 (Department of Insurance)Idaho Code § 41-2710 requires a title insurance agent to obtain a license for each county from the Director of the Department of Insurance and, as a condition of the license, to obtain and pay for a surety bond as provided for an escrow officer. The Department's published guidance sets the bond at a $10,000 minimum per county, rising $10,000 for each additional escrow officer in the county, to a $50,000 maximum. Confirm your required amount with the Department.
