A professional solicitor is anyone who, for compensation, solicits contributions for a charitable organization. Hawaii requires each professional solicitor to file a $25,000 bond with and approved by the Attorney General under HRS 467B-12 before registering with the Tax & Charities Division.
It's a three-party arrangement: you (the principal), the surety carrier, and the State (the obligee). The bond inures to the benefit of the State and is conditioned that the solicitor — its officers, employees, agents, and independent contractors — will not violate HRS chapter 467B.
The bond remains in effect for one year. If the solicitor violates the chapter and the State or the public is harmed, a claim can be made against the bond — and if the surety pays, you repay the surety. We track the term and send renewal notices ahead of expiration.
