About this bond

What it is and who needs it.

What the right-of-way bond actually covers

When a utility, contractor, or property owner needs to build, cut, bore, or place facilities within a Georgia state highway right-of-way, the Georgia Department of Transportation (GDOT) issues an encroachment or driveway permit — and often requires a performance bond with it.

The bond guarantees the permittee will comply with all stipulations, requirements, and specifications of the permit, complete the work to GDOT standards, and restore the right-of-way. It can also extend to any removal or corrective action GDOT determines is necessary, protecting the state's infrastructure and the public.

Because the amount tracks the work, the figure is whatever GDOT sets on your permit. Enter that amount and we issue the bond at a flat 3% with no credit check. Note that some local governments have their own right-of-way bonds — this page is the GDOT (state) performance bond.

GDOT utility encroachment / driveway-encroachment permitsThe Georgia Department of Transportation requires a performance bond with certain utility encroachment and driveway/encroachment permits authorizing work within the state right-of-way (administered through GPAS for utilities; see GDOT's Regulations for Driveway and Encroachment Control and form DOT 8413A). The bond is conditioned on compliance with the permit and restoration of the right-of-way; GDOT sets the amount. Local governments may require separate bonds.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the Georgia right of way performance bond? +
The premium is a flat 3% of the bond amount, with a $275 minimum. GDOT sets the amount on your permit, usually tied to the cost of the work in the right-of-way. Enter that figure and the quote updates.
What does the bond guarantee? +
That you comply with all stipulations and specifications of the GDOT permit, complete the work to standard, and restore the right-of-way. It can also cover removal or corrective action GDOT determines is necessary.
Is this the state or a local bond? +
This is the GDOT (state) right-of-way performance bond. Cities and counties often have their own right-of-way bonds for local roads — tell us which jurisdiction is requiring it and we will issue the right one.
Is there a credit check? +
No — the right-of-way bond is issued with no credit pull. Larger bond amounts may get a quick soft-pull review, which never affects your credit score.
What amount should I choose if I'm not sure? +
Use the figure on your GDOT permit or permit instructions. If it is not stated yet, send us the permit application and we will confirm the amount before issuing.
