About this bond

What it is and who needs it.

What the tree protection bond actually covers

Douglas County regulates tree conservation, buffers, and landscaping for development under Article 8 of its Development Code (Landscaping, Buffers and Tree Conservation). When a project's required trees or landscaping cannot be completed up front, or must be warranted after planting, the county takes a surety bond to guarantee the work.

The bond stands behind the installation and survival of the required trees and landscaping. Typical county practice is a maintenance bond covering a share of the improvement cost, or a performance bond covering uncompleted work — the exact figure is whatever Douglas County Development Services sets for your project.

If the developer fails to install or maintain the required plantings, the county can recover against the bond and use the proceeds to complete the work. It is not insurance for you — if the surety pays, you repay the surety. We issue the county's amount at a flat 3% with no credit check.

Douglas County Development Code, Article 8Douglas County requires landscaping, buffer, and tree conservation for land-disturbing development under Article 8 of its Development Code (Landscaping, Buffers and Tree Conservation). When required, a maintenance or performance bond guarantees the installation and survival of the required trees and landscaping, in an amount set by Douglas County Development Services. Confirm the required amount on your development approval.
