What the garnishment bond actually covers

In Florida a creditor can ask the court to garnish a debtor's wages, bank accounts, or property held by a third party before getting a judgment. Because that is a drastic step taken before the case is decided, Fla. Stat. 77.031 requires the plaintiff to post a bond first.

The bond is payable to the defendant, in at least double the amount of the debt demanded, and the clerk of court must approve the surety. It is conditioned to pay all costs, damages, and attorney's fees the defendant sustains if the plaintiff improperly sued out the writ — that is, if the garnishment turns out to have been wrongful.

So this is a court bond that protects the party you are garnishing, not the state. If the writ was improper and the defendant is harmed, they recover against the bond — and if the surety pays, you repay the surety.
