What the franchise performance bond guarantees

With a few exemptions, no one may collect or haul commercial solid waste over county roads without a nonexclusive commercial franchise from Osceola County (Code sec. 19-21); here commercial solid waste includes construction and demolition debris and recyclables. Each applicant must furnish a payment and performance bond conditioned on the faithful performance of the franchise and all its obligations, including payment of any administrative fines (sec. 19-28). A bank letter of credit may be used instead. Residential collection runs under separate County service agreements, not this franchise.

It is a three-party arrangement: you (the principal), the surety carrier, and Osceola County (the obligee, the party the bond protects). If a franchisee fails to perform the franchise or meet its obligations, including paying administrative fines, the County can recover against the bond.

It is not insurance for you — if the surety pays the County, you repay the surety. Keep it in force: if the bond lapses, the franchise is suspended automatically, and revoked if you do not cure it within ten working days.
