Osceola County requires a surety bond when work in its right-of-way means you must bore and jack or open cut (Land Development Code section 4.12.2). The bond is a public-road guarantee: it stands behind proper restoration of any county road, shoulder, or drainage you bore or cut, and your compliance with the permit conditions and county engineering standards.

It's a three-party arrangement: you (the principal), the surety carrier, and Osceola County (the obligee, the party the bond protects). If a crossing damages the roadway or you fail to restore it to county standard, Osceola County can recover against the bond up to its amount.

It is not insurance for you — if the surety pays a claim, you repay the surety. It is not the only security in the code: a permit to construct improvements within existing county right-of-way also needs an irrevocable letter of credit, or other assurance the County accepts, for 125 percent of the estimated cost of completing the work. Osceola County Land Development Code §4.12.2, subsection F.10 (Bonds)Section 4.12.2 of the Osceola County Land Development Code (Right-of-Way Utilization), subsection F.10 (Bonds), requires an applicant who must bore and jack or open cut to present an executed bond from a company licensed to do business in Florida. The County Manager sets the amount. The bond runs for one year and is renewed each year until the project is complete; the County Manager then presents a certificate to the Board of County Commissioners and the bond may be released.
