What the performance bond actually covers

A City of Orlando performance bond is a completion guarantee. Under section 65.561 of the City Code, the city makes it a condition of approving a development: you agree to build the roads, streets, drainage, sidewalks, sewers and other improvements in the approved plans, within the time they set, and the bond stands behind that promise. Work that disturbs the public right-of-way under a right-of-way or engineering permit uses a different form, the city's Construction Bond.

It's a three-party arrangement: you (the principal), the surety carrier, and the City of Orlando (the obligee, the party the bond protects). If the improvements are not built as the plans require, the city can give 45 days' written notice and have the surety complete them, or build them itself and recover the cost from you and the surety. The city sets the amount for each development.

The premium is 1% of the bond amount, $100 minimum — priced by your bond amount, not a credit or underwriting tier. For larger performance bonds, an underwriter may review the project and your firm before issuance — standard for completion guarantees.

The city form is the Performance Bond (rev. 5.30.2024), published by the Permitting Services Division: it runs to the City of Orlando and guarantees the improvements in development plans on file with the City Engineer.
