What the right-of-way performance bond covers

A Fort Lauderdale right-of-way performance bond, which the City Code calls a construction bond (Sec. 25-112), is a completion and restoration guarantee. When you open the city right-of-way — to bore, trench, connect utilities, or build an apron — the city wants assurance the work will be finished and the pavement, drainage, and surface restored to its standards.

It's a three-party arrangement: you (the principal), the surety carrier, and the City of Fort Lauderdale (the obligee, the party the bond protects). If you break the permit terms or leave the right-of-way unrestored, the city can call on the bond, which also secures permit fees and the record drawings the city requires. The city engineer sets the amount from the type of facilities, the extent of the project, the restoration work required and your past performance on City permits.

The premium is 1% of the bond amount, $100 minimum — priced by your bond amount, not a credit or underwriting tier. For larger amounts, an underwriter may review the project before issuance — standard for performance guarantees.

City of Fort Lauderdale Code of Ordinances Sec. 25-112 (Construction bond)Sec. 25-112 requires a permittee to deposit a construction bond with the city engineer before any construction begins. The city engineer sets the amount from the type of facilities, the extent of the project, the rights-of-way restoration work required and the past performance of the permittee on other City permits. The bond is not released until the rights-of-way have been restored and inspected. Sec. 25-97 defines a permittee as anyone granted a permit to construct in the rights-of-way.
