What the warranty bond actually covers

Florida regulates warranty associations under Chapter 634 of the Florida Statutes: home warranty associations under Part II (§§634.301–634.348) and service warranty associations under Part III. Each must keep a deposit of securities with the state, and the statute lets an association replace part or all of it with a surety bond.

A home warranty association deposits at least $100,000 in securities, or at least $25,000 in securities plus a $75,000 surety bond filed with the Office (Fla. Stat. §634.305). The bond must serve the same purpose as the deposit it replaces, and the Office must approve it. A service warranty association follows §634.405 instead: its security depends on its gross written premiums and on whether it is a warrantor or a warranty seller (for most, $50,000, $75,000 or at least $100,000), and the Office may accept a surety bond in its place.

The bond guarantees the association will faithfully perform its warranty contracts. It cannot be canceled without at least 60 days' written notice to the OIR, and a replacement must be filed within 30 days of any termination notice.
