What the bonded title actually does

When you buy or inherit a vehicle and the paperwork is missing, lost, or defective, Florida lets you establish ownership with a bonded title under Fla. Stat. 319.23. You post a surety bond, the FLHSMV issues a certificate of title in your name, and the bond protects anyone who later proves a superior claim to the vehicle.

The bond amount is two times the vehicle’s current value as determined by the department. You also complete an Affidavit to Accompany Application for Bonded Title (HSMV 82026) describing how you acquired the vehicle, and file the title application at your local tax collector or FLHSMV office.

If someone with a better claim comes forward and is harmed, they can recover against the bond — and if the surety pays, you repay the surety. The bond expires three years from its effective date; after that, if no valid claim was made, the bonded brand drops and a clean title issues.
