What the bond actually guarantees

A freight forwarder and a property broker are each registered by FMCSA only after filing minimum financial security under 49 U.S.C. § 13906 — $75,000 for a freight forwarder under subsection (c) and $75,000 for a broker under subsection (b), the same figure for both roles. FMCSA's prescribed form for the surety-bond option is BMC-84 (a trust-fund alternative, Form BMC-85, is also allowed but is a different filing).

It's a three-party arrangement: you (the principal), the surety carrier, and FMCSA holds the filing as obligee on behalf of the shippers and motor carriers you contract with. The security is available to pay a claim arising from your failure to pay freight charges or carry out your transportation contracts, agreements, or arrangements.

It is not insurance for you — if the surety pays a claim, you repay the surety. Your registration remains in effect only as long as the $75,000 security stays on file; if it lapses or falls below the required amount, FMCSA suspends your registration, so we track the filing and send renewal notices ahead of the term.

49 U.S.C. § 1390649 U.S.C. § 13906(b) and (c) each set a $75,000 minimum financial security — a surety bond, trust fund, or other approved security — before FMCSA will register a person as a broker or a freight forwarder, regardless of the number of branch offices or sales agents. Form BMC-84 is FMCSA's prescribed surety-bond form under 49 CFR § 387.307 for a broker's filing; the same $75,000 figure and process applies to a freight forwarder's financial-security filing under § 13906(c).
