What the bond actually guarantees

Delaware requires anyone engaging in business as a sales finance company — buying retail installment contracts on motor vehicles from dealers, or otherwise financing motor vehicle sales — to hold a license from the Office of the State Bank Commissioner under 5 Del. C. § 2902. Section 2914 of the same chapter requires every licensee to file an original corporate surety bond in the principal sum of $25,000, written by a surety authorized to transact business in Delaware.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Delaware (the obligee). The bond runs to the State for the benefit of the Office of the State Bank Commissioner and of consumers injured by a licensee's wrongful act, omission, default, fraud, or misrepresentation in the course of the licensed business.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond's term must stay commensurate with the license period, so it has to remain continuously on file; we track the term and send renewal notices 60 and 30 days out.

5 Del. C. § 2914Section 2914 of Chapter 29, Title 5 of the Delaware Code (Financing the Sale of Motor Vehicles) requires every licensed sales finance company to file with the Commissioner an original corporate surety bond, with surety provided by a corporation authorized to transact business in Delaware, in the principal sum of $25,000. Licensing itself is required by § 2902, administered by the Office of the State Bank Commissioner.
