What the bond actually guarantees

Delaware requires anyone brokering mortgage loans on Delaware residential real estate to hold a mortgage loan broker license from the Office of the State Bank Commissioner under Chapter 21 of Title 5. Section 2108 requires every licensee to file an original corporate surety bond of $25,000, written by a surety authorized to transact business in Delaware, with a term commensurate with the license period or continuous.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Delaware (the obligee). The bond runs to the State for the benefit of the Office of the State Bank Commissioner and of all consumers injured by any wrongful act, omission, default, fraud, or misrepresentation by a licensee in the course of its licensed activity.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond's expiration date can be no earlier than the date your license expires, so it has to stay continuously on file; we track the term and send renewal notices 60 and 30 days out.

5 Del. C. § 2108Section 2108 of Chapter 21, Title 5 of the Delaware Code (Mortgage Loan Brokers) requires every licensee to file with the Commissioner an original corporate surety bond in the principal sum of $25,000, running to the State for the benefit of the Office of the State Bank Commissioner and of all consumers injured by a wrongful act, omission, default, fraud, or misrepresentation by a licensee. The Commissioner may accept a $25,000 irrevocable letter of credit in lieu of the bond.
