About this bond

What it is and who needs it.

What the bond actually guarantees

Delaware does not let anyone cash a check, draft or money order for a fee without a license. Subchapter II of Chapter 27 of Title 5 puts that licensing in the hands of the Office of the State Bank Commissioner, and § 2714 requires every licensee to file an original corporate surety bond in the principal sum of $5,000, written by a surety authorized to transact business in Delaware, in a form satisfactory to the Commissioner. The chapter reaches fixed storefronts, mobile units — a vehicle or other movable means of cashing checks — and limited stations that serve the employees of a single business.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Delaware (the obligee). The bond runs to the State for the benefit of the Office of the State Bank Commissioner and of every consumer injured by a wrongful act, omission, default, fraud or misrepresentation by a licensee. It compensates a consumer's actual losses — and by statute it does not answer to business creditors, third-party service providers, agents, or people otherwise in the licensee's employ.

It is not insurance for you — if the surety pays a claim, you repay the surety. Claims are paid to the Commissioner's office within 90 days of receipt, with daily interest at the legal rate on anything paid later. A surety cannot walk away quietly either: cancellation is only effective if written notice of intent to cancel is filed with the Commissioner at least 30 days beforehand. Keep the filing continuous — we track your term and send renewal notices 60 and 30 days out.

5 Del. C. § 2714Section 2714 of Chapter 27, Title 5 of the Delaware Code requires every licensed casher of checks, drafts or money orders to file with the State Bank Commissioner, in a form satisfactory to the Commissioner, an original corporate surety bond from a surety authorized to transact business in this State, in the principal sum of $5,000. The bond runs to the State for the benefit of the office of the State Bank Commissioner and for the benefit of all consumers injured by any wrongful act, omission, default, fraud or misrepresentation by a licensee; it compensates actual losses and excludes claims by business creditors, third-party service providers, agents and persons otherwise in the licensee's employ. Surety claims are paid to the Commissioner's office not later than 90 days after receipt, with daily interest at the legal rate afterward, and no cancellation is effective unless the surety files written notice of its intention to cancel with the Commissioner at least 30 days before the effective date. The Commissioner may instead accept an irrevocable letter of credit of $5,000 from an insured depository institution. Neighboring sections size the rest of the licence: § 2713 sets investigation and license fees separately for a fixed location and for a mobile unit, § 2715 requires minimum liquid assets of $5,000 per location or mobile unit, and § 2720 runs every license to December 31 with renewals due at least 30 days before expiration. Confirm your filing package with the Office of the State Bank Commissioner.

FAQ

Common questions.

How much is the Delaware check casher bond? The premium is $100 flat — set by our carrier's rate book for this bond, the same for every licensee. The $5,000 bond amount is fixed by 5 Del. C. § 2714, so there is no quote process.
Do I pay the $5,000?No. You pay $100. The $5,000 is the surety's maximum liability if a valid consumer claim is made against the bond — not a deposit, and nobody holds your money.
How fast will I have the bond?License bonds like this are among the thousands of bond types that issue right after purchase — many licensees finish the application and have the bond in the same sitting. At most, 1–2 business days.
Is there a credit check? The application collects no credit information, so most applicants approve instantly. If a check ever runs on this bond, it's a soft pull that won't affect your score.
Can I post a letter of credit instead of the bond?Section 2714 lets the Commissioner accept an irrevocable letter of credit of $5,000 from an insured depository institution in place of the bond. Most licensees file the bond, because a letter of credit ties up $5,000 of bank collateral while the bond costs $100 a year.
