What the bond actually guarantees

Delaware regulates credit counseling, debt settlement, and other debt-management services under the Uniform Debt-Management Services Act, 6 Del. C. Chapter 24A, administered by the Attorney General. Section 2413A requires every applicant to file a surety bond of at least $50,000, and the Attorney General may increase that amount based on the value of the provider's business in Delaware and the value of its trust accounts.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Delaware (the obligee). The bond runs to the State for the benefit of the Attorney General and of consumers injured by any wrongful act, omission, default, fraud, or misrepresentation by a licensed provider in the course of its licensed activity.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond has to stay on file for as long as you hold the license; we track the term and send renewal notices 60 and 30 days out. C. § 2413ASection 2413A of Delaware's Uniform Debt-Management Services Act requires every applicant for a debt-management services license to file a surety bond of at least $50,000, which the Attorney General may increase in light of the provider's Delaware business and trust accounts. The bond runs to the State for the benefit of the Attorney General and injured consumers; the Attorney General may accept an irrevocable letter of credit of not less than $50,000 in lieu of the bond.
