Section 2714 of Chapter 27, Title 5 of the Delaware Code requires every licensed casher of checks, drafts or money orders to file with the State Bank Commissioner, in a form satisfactory to the Commissioner, an original corporate surety bond from a surety authorized to transact business in this State, in the principal sum of $5,000. The bond runs to the State for the benefit of the office of the State Bank Commissioner and for the benefit of all consumers injured by any wrongful act, omission, default, fraud or misrepresentation by a licensee; it compensates actual losses and excludes claims by business creditors, third-party service providers, agents and persons otherwise in the licensee's employ. Surety claims are paid to the Commissioner's office not later than 90 days after receipt, with daily interest at the legal rate afterward, and no cancellation is effective unless the surety files written notice of its intention to cancel with the Commissioner at least 30 days before the effective date. The Commissioner may instead accept an irrevocable letter of credit of $5,000 from an insured depository institution. Neighboring sections size the rest of the licence: § 2713 sets investigation and license fees separately for a fixed location and for a mobile unit, § 2715 requires minimum liquid assets of $5,000 per location or mobile unit, and § 2720 runs every license to December 31 with renewals due at least 30 days before expiration.
