Delaware regulates health spas — clubs and studios selling prepaid membership or fitness-service contracts — under its Health Spa Regulation Act (Title 6, Chapter 42), administered by the Division of Consumer Protection within the Delaware Department of Justice. The Act conditions the sale of pre-opening and membership contracts on a surety bond or letter of credit filed with the Director, protecting members if a club fails to open or substantially fails to deliver the services sold.

It's a three-party arrangement: you (the principal), the surety carrier, and the Director acting for the State (the obligee), with paying members as the protected parties. If a covered club closes early or doesn't deliver, a member with a valid claim can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. This filing carries a $25,000 penal sum specific to the Anytime Fitness franchise arrangement; a standalone Delaware health spa's statutory bond is $50,000.
