What the erosion control bond actually guarantees
Conn. Gen. Stat. § 22a-329 requires every Connecticut municipality to adopt regulations providing for soil erosion and sediment control on development sites, including a certified control plan for any project disturbing more than half an acre. Montville implements that mandate by conditioning a zoning permit on a surety bond, posted before the permit issues, in a form acceptable to the Town.
It is a three-party arrangement: you (the principal), the surety carrier, and the Town of Montville (the obligee), with the town’s soil and water resources as the protected interest. The bond is not released until the Zoning Officer and/or Director of Land Use & Development confirms your site’s erosion and sediment control measures — silt fence, sediment basins, and final stabilization — are in place and working.
