What the subdivision bond actually guarantees

Connecticut subdivision law, Conn. Gen. Stat. § 8-25, lets a planning commission accept a surety bond, cash bond, or other financial guarantee in place of building a subdivision’s roads, drainage, and utilities before the plan is recorded. The Killingworth Planning and Zoning Commission uses this bond so a developer can record a subdivision and sell lots while still on the hook to finish the required public improvements.

It is a three-party arrangement: you (the principal), the surety carrier, and the Town of Killingworth (the obligee), with future lot owners as the protected parties. Under the statute, the Commission may require a separate financial guarantee for erosion and sediment controls before any improvement work even begins, and if lots are conveyed and the improvements are not finished within the statutory period, the town can call the bond to finish the work.

The commission may require the financial guarantee for erosion and sediment controls before any improvement work commences, and financial guarantees for other improvements may be posted at any time before all approved public improvements are completed. A related provision, § 8-26c, generally requires subdivision work to be completed within five years of plan approval; if lots have been conveyed and the bonded improvements are not finished, the municipality may call the bond to the extent needed to complete them.
