About this bond

What it is and who needs it.

What the Bloomfield right of way bond guarantees

Bloomfield’s Rights of Way Ordinance, adopted in June 2023, requires anyone doing “regulated activities” in a town right-of-way to hold an annual license from the Town’s Authorized Enforcement Agent — currently the Town Engineer. Regulated activities are broad: excavation and construction, connections to the town storm drainage system, temporary or permanent encroachments, moving structures, and removing or trimming trees in or along town streets. An active license is a condition of every individual permit.

The license comes with four prerequisites: a surety bond of at least $10,000, a notarized Indemnification and Hold Harmless Warranty, an insurance certificate naming the Town, and a small license fee. The bond is a blanket, calendar-year bond, not a per-job bond — it guarantees your performance on every permit issued under the license, and if you leave permitted work unfinished, the surety must arrange for its completion. The bond must be written on the Town’s prescribed form unless the Town Engineer approves another form in writing, by a surety licensed in Connecticut, and signed for your company by the same official who signed the warranty.

It is a three-party arrangement: you (the principal), the surety, and the Town of Bloomfield (the obligee). It is not insurance for you — if the Town is paid on a claim, you repay the surety. Letting the bond lapse means immediate suspension of your license and every permit issued under it, so renew it before December 31 each year. The Town Engineer may waive or modify license requirements for government agencies and public service companies.

Bloomfield Rights of Way Permit Manual, Provision 15Town of Bloomfield Rights of Way Permit Manual, Version 2.3 (January 1, 2024), Provision 15: each Permittee, as a license requirement, shall obtain and deliver to the Town, for the benefit of the Town, a surety bond in an amount determined appropriate by the AEA, but in no event less than $10,000, guaranteeing the Permittee’s performance with respect to Regulated Activities, kept in force for the duration of the license and in the form prescribed by the Town Manager. Code of Ordinances Sec. 17-33 makes the license annual, expiring December 31, and obliges the permittee to maintain the security bond set out in the Permit Manual. Provision 5.a designates the Town Engineer as the AEA; Provision 19.a suspends the license and all its permits on any lapse. The Town’s bond form runs to December 31 of the year of issuance, renewable by continuation certificate.

✓

Claims, renewal, filing, and what sets the price.

If a claim is made

A claim comes from the party the bond protects, the obligee named on the form, when the duty the bond guarantees is not met.

The surety investigates and pays a valid claim, up to the bond amount. You then repay the surety: a surety bond is a guarantee of your performance, not insurance for you.

Renewal and term

Term and renewal are set in the underwriter's quote.

Keep the bond in force for as long as the obligation behind it runs.

How to file it

Pay, sign & upload to the Town. Once you accept the quote and pay, the executed bond is prepared on the Town of Bloomfield’s Rights of Way Permit Bond form with the surety’s power of attorney attached. Upload it to your license application in the Town’s online permit portal, alongside the notarized indemnification warranty and your insurance certificate.

What sets the price

This bond is underwritten: the premium is quoted from the bond amount and your financial picture, so there is no flat price to show.

FAQ

Common questions.

What is a Bloomfield, Connecticut right of way bond?It is the surety bond, at least $10,000, that the Town of Bloomfield requires as a condition of its annual Rights of Way license. Every contractor who works in a town street or right-of-way needs that license before any permit is issued, and the bond guarantees the contractor’s work under all of those permits complies with the Town’s ordinance and Permit Manual.
Who sets the bond amount? The Town Engineer, acting as the Town’s Authorized Enforcement Agent. Provision 15 of the Permit Manual sets the amount at whatever the Engineer considers appropriate, but never below $10,000. Most contractors file the $10,000 minimum; if the Engineering Division asks for more because of the scale of your work, enter that figure instead.
How much does it cost? This bond is not on our carrier’s published rate sheet, so we quote it on review instead of showing a number checkout might not match. Submit the application and a surety specialist confirms your exact premium, typically within one business day. The $10,000 is the surety’s maximum liability to the Town, not something you pay.
Will I need collateral?Rarely at this size. If the review ever turned up a reason to ask for collateral, we would tell you before you commit to anything. The bond issues the moment you pay — no credit review of any kind, not even a soft pull.
How do I file it, and when does it renew?Upload the executed bond, on the Town’s Rights of Way Permit Bond form, to your license application in Bloomfield’s online permit portal, with the notarized indemnification warranty, your insurance certificate and the license fee. The license and bond both expire December 31. Renew by continuation certificate so your license — and every permit under it — is never suspended.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
