What the tag agency bond actually covers

Arizona lets private businesses act as authorized third parties for the Motor Vehicle Division — the “tag agencies” that issue titles, registrations, plates, and related services the MVD would otherwise handle. A.R.S. § 28-5104 conditions that authorization on a surety bond running to the State of Arizona as obligee.

The bond is conditioned that the tag agency will faithfully comply with the provisions of law governing its authorization, protecting the state and the public — including the customer funds and fees the agency collects on the MVD’s behalf. It is noncancellable without at least sixty days’ prior notice to the director.

For title and registration service providers, the statute sets the bond at at least $100,000 for each location.
