What the bond actually guarantees

Alaska regulates small loan and consumer finance lenders through the Division of Banking and Securities under the Alaska Small Loans Act, AS 06.20. A license applicant files a $25,000 bond approved by the department under AS 06.20.050, with one or more sureties.

The bond runs to the state and to any person who may have a cause of action against you — it stands behind your promise to conform to AS 06.20 and the department's regulations, and to pay the state and borrowers any money that becomes due under the chapter. It's a three-party arrangement: you (the principal), the surety carrier, and the state and your borrowers as protected parties.

It is not insurance for you — if the surety pays a claim, you repay the surety. The license renews annually, so the bond has to stay continuously on file; we track the term and send renewal notices 60 and 30 days out.
