Federal Regulations: Davis-Bacon wages apply to this project and are made a part of these contract documents
as required in the provisions of the Federal-Aid Highway Act of 1968. This contract is subject to all appropriate
Federal Laws, including Title VI of the Civil Rights Act of 1964 and the Fair Labor Standards Act of 1938, (52 Stat.
1060). SEE CERTIFIED PAYROLL SPECIAL REQUIREMENTS ATTACHMENT.
The project is to be completed: to be determined by competitive bidding.
Other Requirements:
Contractors who want to do a press release or use UDOT's name in any way, need permission from
UDOT's Communications Office.
ANTI-BOYCOTT ISRAEL ACT: Unless Utah Code § 63G-27-201(2) applies, Contractor/Consultant certifies it is
not currently engaged in boycotting the State of Israel and agrees not to engage in a boycott of the State of Israel
for the duration of the contract.
Contractors must acknowledge they understand the Utah Legislature encourages employment of Utah workers
and the proliferation of Utah business in carrying out the promises they make under this contract, which the
Legislature made possible by funds it appropriated in 2021 Utah Laws Ch. 387 (H.B. 433).
All project bidding information, including Specifications and Plans, can be viewed, downloaded, and printed from
UDOT's Project Development Construction Bid Opening Information website,
https://contractorzone.udot.utah.gov/projects.The UDOT's Bidding Business System link is also available on this
website, for the UDOT Bid System - Masterworks. Bidders must use the UDOT Bidding Business System when
bidding on a UDOT project.
Project information can also be reviewed at the main office in Salt Lake City, its Region offices, and its District
offices in Price, Richfield, and Cedar City.
Project Plans cannot be downloaded or printed from the website unless your company is registered with UDOT.
Go to UDOT's website to register. Registered companies may also obtain a share drive of the advertising project
files only in the instance where on-line electronic files may not be obtainable due to on-line technical difficulties.
These files contain all the project advertising documents and would be available from the main office, 4501 South
2700 West, Salt Lake City.
As required, a contractor's license must be obtained from the Utah Department of Commerce to work on UDOT
projects as defined from the Division of Professional Licensing.
Qualified Health Insurance
A prime contractor is subject to qualified health insurance requirements if the prime contract is in the amount of
$2,000,000 or greater. A subcontractor is subject to qualified health insurance requirements if the subcontract is in
the amount of $1,000,000 or greater. The Contractor will demonstrate compliance with qualified health insurance
requirements at the time of the execution of each initial prime contract.
The Contractor will demonstrate to the Department that the Contractor has and will maintain an offer of qualified
health insurance coverage for the contractor's employees and the employee's dependents during the duration of
the contract.
If a subcontractor of the Contractor is subject to qualified health insurance requirements, the Contractor will place
a requirement in the subcontract that the subcontractor will obtain and maintain an offer of qualified health
insurance coverage for the subcontractor's employees and the employee's dependents during the duration of the
subcontract; and certify to the Department that the subcontractor has and will maintain an offer of qualified health
insurance coverage for the subcontractor's employees and the employee's dependents during the duration of the
prime contract.
Bid Bond
Each bidder must submit an electronic bid bond from an approved surety company through the appropriate
clearinghouse, as defined in the UDOT E-Bidding Guide, using UDOT's Bidding Business System or in lieu
thereof, cash, certified check, or cashier's check for not less than 5% of the total amount of the bid, made payable
to the Utah Department of Transportation, showing evidence of good faith and a guarantee that if awarded the
contract, the bidder will execute the contract and furnish the contract bonds as required.
The right to reject any or all bids is reserved.

After the evaluations and final determination of proposals are complete, the State will award the contract as soon
as practicable to the lowest responsive and responsible bidder, subject to Section 63G-6a-709(2).
All bidders are to note the State of Utah Procurement Code requires the awarded contractor, for the duration of
any contract awarded through this bidding process, to make available company contact information to the
Department of Workforce Services in accordance with Utah Code 35A-2-203.
Contractor will provide information regarding job vacancies to the State of Utah Department of Workforce
Services, which may be posted on the Department of Workforce Services website. Posted information will
include the name and contact information for job vacancies. This information will be provided to the State of Utah
Department of Workforce Services for the duration of this Contract. These requirements do not preclude a
Contractor from advertising job openings in other forums throughout the State of Utah.

NOTICE TO CONTRACTORS
Special Requirements Attachment
CERTIFIED PAYROLL
Construction contractors awarded a Federal-aid construction project are required to submit weekly certified
payrolls to the Utah Department of Transportation using the (UDOT) e-Comply Certified Payroll System.
Submittal may be accomplished using one of two available options:
Option 1
The Contractor manually enters the certified payroll information into e-Comply and saves it. The Contractor is
required to fix the issues related to any payroll errors.
Option 2
The Contractor can utilize the Payroll Import feature if the Contractor's payroll system provides the correct
template format. In order to utilize the Payroll Import feature, the contractor must contact e-Comply support at
support@ecomplysolutions.com for payroll import setup and training. The Contractor is required to fix the issues
related to any payroll errors. If the issues related to import or payroll errors cannot be resolved with the import
feature, the Contractor will need to use Option 1 for payroll entry.
NOTE: Make sure that all apprentice payroll information is accurate and imported correctly, or else the hours for
these employees’ work will not count towards the on-the-job trainee project goal.
A $50 disincentive may be charged per payroll for each week the payroll is not entered into the UDOT e- Comply
Certified Payroll Program within 7 days of the Payroll Date. This disincentive applies to both the General
Contractor and all Subcontractors where Davis Bacon Wages apply.
