SPECIAL NOTICE 1
120 CALENDAR DAYS ARE ALLOWED FOR CONSTRUCTION ON
CITY OF FAIRBURN – CITYWIDE GUARDRAIL INSTALLATION
AND REPAIR PROJECT. CONTRACTOR WILL BE ASSESSED
LIQUIDATED DAMAGES IN THE AMOUNT OF $750.00 PER
CALENDAR DAY FOR FAILURE TO COMPLETE THE PROJECT
ON SCHEDULE.
THE CONTRACTOR IS ADVISED THE AMOUNT OF SUCH
CHARGES IS HEREBY AGREED UPON AS FIXED LIQUIDATED
DAMAGES DUE THE CITY AFTER THE EXPIRATION OF THE TIME
FOR COMPLETION SPECIFIED IN THE CONTRACT. THE
CONTRACTOR AND HIS SURETY SHALL BE LIABLE FOR
LIQUIDATED DAMAGES IN EXCESS OF THE AMOUNT DUE THE
CONTRACTOR ON THE FINAL PAYMENT.
THESE FIXED LIQUIDATED DAMAGES ARE NOT ESTABLISHED
AS A PENALTY BUT ARE CALCULATED AND AGREED UPON IN
ADVANCE BY THE CITY AND THE CONTRACTOR DUE THE
UNCERTAINTY AND IMPOSSIBILITY OF MAKING A
DETERMINATION AS TO THE ACTUAL AND CONSEQUENTIAL
DAMAGES WHICH ARE INCURRED BY THE CITY, THE STATE,
AND THE GENERAL PUBLIC AS A RESULT OF THE FAILURE ON
THE PART OF THE CONTRACTOR TO COMPLETE THE WORK ON
TIME.

The project consists of guardrail installation and repair at multiple locations throughout the City of Fairburn. Work includes traffic control, erosion control, grading complete, guardrail (TP T and TP W), guardrail anchorage (TP 1), guardrail terminal (TP 12A, 31 in, tangent, energy absorbing), and grassing complete. All guardrail and anchor materials and installation must comply with current GDOT specifications. The contractor is responsible for coordination with utility owners via Georgia 811. All debris must be removed from the site upon completion.
