What the bond actually guarantees

Wyoming lets an out-of-state RV dealer not licensed in Wyoming hold a temporary recreational vehicle display and sales event under a permit. Under W.S. 31-16-127, the application must be accompanied by a $50,000 cash or surety bond from a surety licensed in Wyoming, filed at least 90 days before the event.

The bond is conditioned that the dealer commit no fraud or fraudulent misrepresentation and violate no federal or state law relating to the business, and that the dealer return the permit, demo plates, and any unused temporary permits and stubs. It is forfeited to the department on a violation of the act.

If a buyer or the state is harmed by the dealer's conduct at the event, recovery comes against the bond — and if the surety pays, the dealer repays the surety. The department returns the bond within 30 days if no sales occurred, or one year after the last sale if all conditions are satisfied.
