What the bond actually guarantees

The City of Superior requires all contractors, building contractors, electrical contractors, HVAC contractors, and plumbers to register with the city to perform work within the City of Superior, under Sec. 34-57 of the Superior Code of Ordinances. As a condition of registration, Sec. 34-60 requires a $25,000 surety bond, an annual aggregate of all losses, plus a certificate of general liability insurance.

It is a three-party arrangement: you (the principal), the surety carrier, and the City of Superior (the obligee), with the city and any homeowner, association, corporation, governmental agency, or other person who suffers injury or financial loss as the protected parties. The bond binds the contractor and surety to the city and those parties for the contractor’s failure to comply with city and state law or to sufficiently complete work engaged in.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond must extend for the same period as the registration and cannot be cancelled except on 20 days' written notice to the building inspector; annual fees run January 1 through December 31 of the calendar year. Registration exceptions apply to certain owner-performed work and to persons regulated under Wis. Stat. ch. 196.

Superior Code of Ordinances, Sec. 34-56 to 34-63The Superior Code of Ordinances, Chapter 34 (Construction Code), Article III — Qualifications, Certifications and License (Sec. 34-56 to 34-63), requires all contractors, building contractors, electrical contractors, HVAC contractors, and plumbers to register with the City of Superior to perform work within the city (Sec. 34-57). Sec. 34-60(1) sets the bond at $25,000, an annual aggregate of all losses, extending for the same period as the registration and cancellable only on 20 days' written notice to the building inspector; Sec. 34-60(2) also requires a certificate of insurance ($1,000,000 aggregate bodily injury / $100,000 property damage, or a $1,000,000 combined single limit). Registrations and their fees run the calendar year, January 1 through December 31 (Sec. 34-59(b)). Certain owner-performed work on a commercial building or the owner's occupied one- or two-family dwelling is exempt from the contractor license requirement (Sec. 34-57(A)(3)), as are retailers of certain domestic gas appliances and persons regulated under Wis.
