What the bond actually guarantees

Wisconsin licenses earned wage access services providers — companies that let workers access wages they've already earned before the regular payday — through the Department of Financial Institutions' Division of Banking, using the Nationwide Multistate Licensing System (NMLS). A provider may not offer earned wage access in Wisconsin, even from outside the state, without holding that license.

Licensure is conditioned on a $25,000 surety bond running in favor of the State of Wisconsin for the benefit of any person damaged by a violation of the earned wage access chapter, and separately in favor of any such damaged person directly. It's a three-party arrangement: you (the principal), the surety carrier, and the state (the obligee), protecting workers and other harmed parties.

It is not insurance for you — if the surety pays a claim, you repay the surety, and the surety's liability is capped at the $25,000 bond amount and limited to actual damages, not punitive damages. The bond must stay in force for as long as the license is active, so we track it and notify you 60 and 30 days out to keep the filing continuous.
