What the bond actually guarantees

Washington licenses bail bond agencies under chapter 18.185 RCW, administered by the Director of the Department of Licensing. Before a license issues, RCW 18.185.070 requires the agency's qualified agent — here, the owner of a sole proprietorship — to file a bond executed by an authorized surety, in the sum of $10,000, made payable to the State of Washington.

The bond is conditioned to recover against the agency and its servants, officers, agents, and employees for a violation of RCW 18.185.100, which requires the agency to keep three years of records on collateral and bail transactions, deposit collateral into a federally insured trust account within three banking days without commingling, and return collateral to the person entitled to it within five business days of a court's exoneration of the bond.

It is not insurance for the agency — if the surety pays a valid claim, the agency repays the surety. The bond must stay on file for as long as the license is active, and the license renews annually, so we track the term and send renewal notices ahead of expiration.
