A bail bond agency is the business that sells and issues corporate surety bail bonds, or provides security in the form of personal or real property, to secure a defendant’s court appearance. Washington conditions the agency’s license on a bond filed with the Department of Licensing — the agency operates through a qualified agent (an owner, sole proprietor, partner, manager, officer, or chief operating officer who meets the chapter’s requirements) who must file the bond before a license issues.
RCW 18.185.070 requires the bond in the sum of ten thousand dollars, made payable to the state of Washington, conditioned to recover against the agency and its servants, officers, agents, and employees for a violation of RCW 18.185.100 — the statute governing an agency’s handling of bail transactions. A qualified agent may instead deposit $10,000 in an interest-bearing account in lieu of a bond.
It is not insurance for the agency — if the surety pays a claim, the agency repays the surety. The bond must stay in force for as long as the license is active, so we track the term and send renewal notices ahead of expiration.
