What the auctioneer bond actually covers

Washington licenses auctioneers and auction companies through the Department of Licensing under chapter 18.11 RCW, and conditions the license on a surety bond on file with the department. The bond is a public-protection guarantee: it stands behind the money you handle for consignors and buyers, and your compliance with auctioneer law.

Under chapter 18.11 RCW, an auctioneer’s bond is $5,000 and an auction company’s is not less than $5,000 and not more than $25,000. DOL sets the auction company figure from the value of the goods and real estate sold at its auctions — for an existing company, the previous calendar year; for a new company, an estimate for the current year. This filing names the principal as a partnership.

If an auctioneer commits fraud, fails to remit proceeds, or doesn’t pay required taxes, fines, or fees, the harmed party can recover against the bond — and if the surety pays, you repay the surety. We write the amount DOL set, from $100, with most applicants qualifying at or near that minimum.

Chapter 18.11 RCWChapter 18.11 RCW conditions an auctioneer or auction company license on an approved surety bond (or other security) on file with the Department of Licensing. RCW 18.11.121 sets an auctioneer’s bond at $5,000 and an auction company’s at not less than $5,000 and not more than $25,000, based on the value of the goods and real estate sold at the company’s auctions during the previous calendar year — or, for a new auction company, the estimated value for the current calendar year. Confirm your required amount on your DOL license.

FAQ

Common questions.

How much is the Washington auctioneer bond?Premiums are 1% of your bond amount, with a $100 minimum. The bond amount itself is $5,000 for an auctioneer, or $5,000 to $25,000 for an auction company, as set by DOL. Enter that figure at the application and your exact price appears.
How does DOL decide my amount? An auctioneer’s bond is fixed at $5,000. For an auction company, DOL works from the value of the goods and real estate sold at its auctions — the previous calendar year for an existing company, or an estimate for the current year for a new one — and the result lands between the $5,000 minimum and the $25,000 maximum.
Why does this say “Partnership”?It’s the same auctioneer bond, but the bond form names the principal by entity type. This filing is for an auction business organized as a partnership; we also write the LLC and sole-proprietor versions.
Is there a credit check? The application collects no credit information at the standard amount. Most applications approve instantly.
What does the bond protect against? It protects the public — consignors and buyers — if you commit fraud, fail to remit proceeds, or don’t pay required taxes, fines, or fees. If the surety pays a claim, you repay the surety.
