When a plaintiff wants to levy on or seize property before judgment, Virginia requires a bond to protect against a wrongful levy. Code of Virginia § 8.01-537.1 says the plaintiff, or someone for the plaintiff, must give a bond with approved surety (or a cash or property bond) at the time of suing out an attachment or other pretrial levy or seizure.
The bond is conditioned to pay all costs and damages awarded against the plaintiff, or sustained by any person, by reason of a wrongful levy or seizure. The amount is set by the court: at least the estimated fair market value of the property for a levy, and at least double that value for a seizure (a property bond runs double either way).
