Virginia taxes motor fuel under the Virginia Fuels Tax Act, administered by the DMV. A refiner — a person who owns, operates, or controls a refinery — is among the licensees the Act treats alongside suppliers, and is liable for the tax on the fuel it produces and removes.
Under Code of Virginia § 58.1-2211, a license applicant must file a bond or certificate of deposit conditioned on compliance with the Fuels Tax Act and payable to the Commonwealth. The Act has no separate refiner bond: § 58.1-2204(A)(1) says a refiner "shall be licensed as a supplier", and subsection A(1) of § 58.1-2211 fixes the bond at $2,000,000 for a supplier who is a position holder or receives fuel in a two-party exchange. Only a supplier that provides nothing but fuel alcohol posts three times its monthly tax instead.
