What the erosion and sediment control bond covers
Chesterfield County's Department of Environmental Engineering administers erosion and sediment control for construction projects under the County's Stormwater Management and Water Quality Ordinance and Virginia's erosion-control law. Before issuing a land-disturbance permit, the County can require a performance bond so the work is completed even if the permit holder defaults.
The bond guarantees you will install and maintain the approved conservation measures — silt fence, sediment basins, stabilization — through the life of the project. If you fail to, the County can draw on the bond to take corrective action at your expense.
Under Virginia law, the bond amount cannot exceed the estimated cost to initiate and maintain the conservation measures, plus a reasonable allowance for administrative costs and inflation (capped at 25% of the estimated cost).
