What the conduct bond actually guarantees

The conduct surety bond is the bond most Texas retail alcohol permittees post under Alcoholic Beverage Code §11.11. For a private club malt beverage and wine permit (NB), it's a good-conduct guarantee: that you'll operate in compliance with the Alcoholic Beverage Code and the rules of the Texas Alcoholic Beverage Commission.

It's a three-party arrangement: you (the principal), the surety carrier, and the Commission (the obligee). The bond must say on its face that you will not violate a law relating to alcoholic beverages or a Commission rule, and that the amount of the bond is paid to the state if the permit is revoked or on final adjudication that you violated the Code — §11.11(b)(2).

The standard amount is $5,000 ($10,000 if you're within 1,000 feet of a public school). The bond is filed on TABC form L-2-60.2. It is not insurance for you — if the surety pays, you repay the surety.

Section 11.11 was added by Acts 1993, 73rd Leg., ch. 934, §19 and last amended in 1995, and §11.11(e) exempts some holders of three years' standing — confirm the amount and applicability for your permit on your TABC notice or in AIMS.
