What the mixed beverage bond actually covers

Texas taxes mixed beverages two ways: a 6.7% gross receipts tax and an 8.25% sales tax. A permittee posts security with the Comptroller for the payment of these taxes — this bond covers the mixed beverage sales tax. (The gross receipts tax is a separate bond.)

Under Tax Code Chapter 183 — § 183.025 for the gross receipts tax, and § 183.043, which applies Chapter 151’s security provisions to the sales tax — the Comptroller fixes each bond amount. For mixed beverage permits effective on or after January 1, 2014, the Comptroller sets the mixed beverage sales tax bond at $3,750 to $100,000, or four times your average monthly tax liability, whichever is greater.

The bond gives the Comptroller a way to recover unpaid mixed beverage sales tax — if you fail to remit, the state can claim against it, and if the surety pays, you repay the surety.
