About this bond

What it is and who needs it.

What the driveway bond actually covers

Tennessee law requires a permit before constructing a driveway on a state highway right-of-way, including modifying or changing the use of an existing driveway. TDOT issues the permit through its regional Traffic Engineering offices and conditions it on a surety bond running to the Department — the same right-of-way framework as its highway entrance permits.

The bond guarantees you build the driveway at the location and in the manner shown on your approved plans, and that you restore to original condition any pavement, shoulders, or other parts of the highway your work damages. The amount is 110% of the estimated construction cost, or $5,000, whichever is greater.

If you deviate from plan or leave the right-of-way damaged, TDOT can recover against the bond to make repairs — and if the surety pays, you repay the surety. We issue the amount on your permit at a flat 3% with no credit check.

Tenn. Dept. of Transportation — Driveway / Entrance rules (Ch. 1680-10-01)TDOT permits for constructing driveways on state highway rights-of-way are issued under the authority of Tenn. Code Ann. §§ 54-5-301 and 54-5-302 and Department rules (Chapter 1680-10-01), informed by the TDOT Manual for Constructing Driveway Entrances on State Highways. The bond runs to TDOT, guarantees construction per the approved plans and restoration of the right-of-way, and is set at 110% of estimated construction cost or $5,000, whichever is greater.
